1. Parties and scope

These Terms of Use govern the use of the vioai.com website and the VioAI mobile application (the "Platform"), operated by [ŞİRKET UNVANI] ("VioAI", "we").

By using the Platform you accept these terms and the Privacy Policy. If you do not accept them, do not use the Platform.

2. Definitions

  • Business: a commercial user publishing its own products on the Platform
  • Manager: the authorised person managing the account for the Business
  • Staff: a user invited by a Manager, holding limited permissions
  • End Customer: a visitor who scans a QR code or browses via Discover
  • Content: product names, descriptions, images, prices, 3D/AR assets and any other data uploaded by the Business

3. Accounts and access

A business account is opened once the application is approved by VioAI. Approval is required and an application may be rejected.

  • You are responsible for keeping your account information accurate and current.
  • You are responsible for the confidentiality of your password and for actions taken through your account. Notify us immediately of any unauthorised use.
  • Staff accounts are created only by Manager invitation. Permissions are set by the Manager; if no branch is assigned to a staff member, that member can see all branches of the Business — check the branch assignment when adding staff.
  • You may not transfer or share your account with third parties.

4. Obligations of the Business

The Business is solely responsible for the Content it publishes and undertakes that:

  • The Content is accurate, current and not misleading — in particular price, portion, dimensions, ingredients and allergen information
  • It holds the necessary intellectual property rights or permission to use the Content
  • Product photos do not include third parties' likeness, personal data or trademark rights without permission
  • It complies with applicable law, in particular consumer protection and food labelling rules

VioAI is not obliged to review Content in advance, but may remove Content it considers to breach these terms.

5. Prohibited use

The following are prohibited:

  • Publishing misleading, unlawful, hateful, obscene Content or Content that infringes third-party rights
  • Reverse engineering the Platform or circumventing security measures
  • Bulk data extraction (scraping) or sending excessive requests
  • Attempting to access another Business's data
  • Using QR codes, venue codes or brand pages in a misleading way

6. Intellectual property

The Platform itself — software, interface, trademarks and design — belongs to VioAI. These terms grant you no rights other than to use the Platform.

Ownership of Content remains with the Business. The Business grants VioAI a non-exclusive, worldwide licence limited to the term of the service to publish, display, scale and convert the Content into 3D/AR form. The licence ends when the account is closed.

7. Use by End Customers

End Customers may use the Platform without creating an account. With an account, scan history, favourites and lists are stored privately for them.

Product information shown to End Customers is entered by the relevant Business. The Business is the counterparty regarding price, contents and availability; VioAI does not guarantee the accuracy of that information and is not a party to the sales contract.

8. Important notice about 3D/AR content

An AR view is representative. Colour, texture, size and portion perception vary with the device, lighting, camera and surface, and may not match the real product exactly. Do not base a purchase decision on the AR view alone.

Also:

  • Surface-based modes (table, floor, wall) run with real AR tracking.
  • Body, face, foot and wrist modes have NO real AR tracking — only a 3D preview is shown. This is stated clearly in the interface.
  • 3D models are currently produced manually; the automated production pipeline is not yet live. A product may not have a 3D asset available.

9. Availability, interruption and change

The Platform is provided "as is" and "as available". No uptime, uninterrupted operation or error-free performance is promised.

Service may be suspended temporarily for maintenance, security or technical necessity. We may add, change or remove features; changes that materially affect a Business are announced with reasonable notice.

10. Fees

Pricing is governed by the separate service agreement between the Business and VioAI: [ÜCRETLENDİRME]. These Terms of Use alone do not grant a right to free use.

11. Limitation of liability

To the maximum extent permitted by applicable law, VioAI is not liable for:

  • Indirect damages, loss of profit, loss of data, loss of reputation
  • Damages arising from Content published by a Business
  • Disputes arising from the relationship between an End Customer and a Business
  • Damages arising from outages of third-party providers (hosting, database, e-mail)

This limitation does not cover mandatory rights under consumer legislation, nor cases of intent or gross negligence.

12. Suspension and termination

In case of a material breach of these terms we may suspend or close your account, with notice or — in urgent cases — without notice.

A Business may close its account at any time. On closure the brand page and products are unpublished. Deleted records are held in a recycle bin for a limited period so they can be restored, and are then permanently deleted.

13. Personal data

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these terms.

14. Changes and versioning

These terms may be updated. On an update, the version and effective date at the top of the page change. For material changes you will be asked to accept the new text when you sign in. Your acceptance is stored against the version you accepted.

15. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of [ŞEHİR] have jurisdiction. Users qualifying as consumers retain the right to apply to consumer arbitration committees and consumer courts.
